The policy takes into account the requirements laid down by the Medicines Act 1968, the Misuse of Drugs Act 1971, the Care Standards Act 2000 if the Care home is in England or Wales, the Adults with Incapacity (Scotland) Act 2000 if the Care Home is in Scotland, the Regulation of Care (Scotland) Act 2001 if the Care Home is in Scotland, the Mental Capacity Act 2005 if the Care Home is in England or Wales, the Health Act 2006, as well as those laid down in the Misuse of Drugs (Safe Custody) Regulations 1973 and regulations amending the same, the Misuse of Drugs Regulations 2001 and regulations amending the same, the Controlled Drugs (Supervision of Management and Use) Regulations 2013, and any amendments of the same.
